1. Mencap: Your views on Special Educational Needs provision

The government has announced plans to reform the special educational needs (SEN) system as part of its Children and Families Bill. The main proposals from the government are:

- Statutory assessments and statements of SEN are replaced by education, health and care need assessments and education, health and care plans (EHCPs) which run from birth to 25.

- There are no new duties on health and social care in relation to delivering the content of an EHCP and the plan will cease when a young person is no longer in education and training.

- Local authorities must produce information on the education, health and care services it expects to be available locally (the local offer).

- Local authorities and clinical commissioning groups must make arrangements for jointly commissioning services for children with SEN in their area.

- EHCPs extend statutory rights into the further education and training sector for the first time.

- School Action and School Action Plus will be merged into a single category and the SEN Code of Practice will be replaced.

- The parent or young person can participate in optional mediation before they can appeal to the Tribunal.

- These provision do not apply to children if they do not have special educational needs. This could include some disabled children and young people who do not have recognised additional educational needs.

- All of the provisions in the Bill will apply to academies in full.

This survey will help Mencap to relay your views on the government's proposals so that we can ensure it is as responsive to the needs of children and young people with a learning disability and their families as possible.
