III Guidelines for Coordination of Multinational Enterprises
Coordination of Proceedings When the Coordination Center’s Home Country Cannot Assert Jurisdiction Over Some Or All of the Enterprise Members, or Where There Is No Coordination Center
Where the coordination center’s home country cannot assert jurisdiction over a meaningful segment of the enterprise members, or where it is determined that a single coordination center is not appropriate because the enterprise lacks sufficient integration to justify full central coordination, coordination of the multinational enterprise group insolvency is nevertheless important. In such cases, these Guidelines apply.
