  1. Period of Agreement
    1. This agreement shall be in effect during the 2009-2010 academic year according to the following dates. The residence halls open on Sunday, August 30, 2009 at 8:00AM and close for winter break on Saturday, December 19, 2009 at 8:00AM . The residence halls re-open on Sunday, January 17, 2010 at 8:00AM and close on Monday, May 17, 2010 at 8:00AM .
    2. The residence halls are closed from Saturday, December 19, 2009 at 8:00AM through Sunday, January 17, 2010 at 8:00AM . During this period, students must find off campus housing. Sontag Apartment residents may be allowed to remain in their rooms over break with permission from the Dean of Residential Life.
    3. Failure to comply with these residency dates and times will result in a $100.00/day fine, eviction from campus until the residence halls open, and potential JB/DB sanctions.
  1. Termination
    1. This agreement acknowledges that living in the residence halls is a privilege. This agreement may be terminated by the student upon written approval of the College. The student shall be entitled to a prorated refund of board charges (if s/he is on the board plan) for any such period paid beyond the effective College-approved termination date, provided the student has completed the established check-out procedure and paid any outstanding amounts owed the College. There will be no refund of room charges.
    2. The College may terminate this agreement for any one or more of the following reasons:
      1. Indications that the student's behavior could result in harm to her/himself or others.
      2. Failure of the student to make a required payment for room and/or board (after receiving written notice).
      3. Failure of the student to maintain enrollment with the College.
      4. Violation of any state or federal law, this Residence Hall Agreement, or policies as stated in the Student Handbook .
  1. The College Shall:
    1. Provide the student with an assigned space in a residence hall.
    2. Provide each student with the following furniture: single bed, mattress, dresser, desk, and desk chair.
    3. Furnish meals in accordance with the student's choice of meal plan when the College is in session. All students are required to be on a meal plan (excluding Linde apartment, Atwood efficiency, and upperclass Sontag residents).
    4. Provide cleaning service in all residence hall rooms, bathrooms, and public areas (as described in the Student Handbook ).
  1. The Student Shall:
    1. Pay all room and board charges in accordance with dates and statements set forth by the College.
    2. Pay the $150.00 damage deposit in accordance with the 2009 Room Draw Regulations. The deposit shall be returned to the student if s/he leaves prior to occupying the room, or the beginning of the semester.
    3. Not change, alter, or modify the room, bathroom, suite, lounge, or apartment or its furnishings or fixtures, without consultation and written approval from the Facilities and Maintenance Office (F&M). This includes, but is not limited to, wallpapering or other non-reversible marking on walls. Decorations must be hung with devices that do not damage wall surfaces. Painting of rooms is allowed so long as it adheres to the guidelines described in the Student Handbook .
    4. Not tamper with, cover, or disable fire safety equipment and/or smoke detectors. These actions are dangerous and unlawful, and will result in JB/DB sanctions and potential loss of housing privileges.
    5. Abide by all state and federal laws and all residence hall policies and procedures as identified in the Student Handbook . Violations may become basis for administrative and/or disciplinary action up to and including expulsion from the College.
    6. Be aware that if one resident vacates a double room, the remaining resident must be willing to accept another roommate or move to another room at the discretion of the Dean of Residential Life.
    7. Not move or live in a different room than the one originally assigned unless the student receives permission to move by the Dean of Residential Life. Unauthorized room changes may result in a $50 fine, restoration of the original assignment, and/or DB/JB referral.
    8. Be financially responsible for room, bathroom, suite, lounge, apartment, and/or residence hall damage. Costs shall be established at the College's reasonable discretion and payment of such costs shall be made by the student within 15 days of written notice from the College. If not paid, the costs will be deducted from the student's damage deposit or charged to her/his student account. If the cause of any loss or damage to the residence hall, its common areas, furnishings, or fixtures cannot be determined after reasonable investigation by the College, the cost of the loss or damage shall be prorated to each student assigned to the residence hall (or suite, if appropriate) regardless of whether the student was present in the residence hall at the time of the loss or damage.
    9. Turn in room key(s) at the end of each semester to F&M, if requested. Students will be notified of each key collection schedule. Failure to turn in room keys will result in a re-key fee of $75.00/key.
    10. Evacuate the residence hall in the event of an emergency and/or evacuation drill.
  1. It is Further Agreed That:
    1. Authorized personnel may enter the student's room for cleaning, maintenance or repairs, for purposes of maintaining compliance with health and safety regulations, and in the case of an emergency or building evacuation. All other entries will be in compliance with state and federal laws and College policies found in the Student Handbook .
    2. While all reasonable precautions will be taken to safeguard the personal property of students, the College assumes no responsibility and provides no insurance or financial protection for students' personal property.
    3. Unless given prior authorization by the Dean of Students Office (DOS), students will not enter residence halls when they are closed. Unauthorized students found in a residence hall will be subject to a $100.00/day fine, eviction from campus until the residence halls open, and potential JB/DB sanctions. Furthermore, unauthorized students are not allowed to stay as guests of authorized students while the residence halls are closed, and will be subject to the unauthorized persons' fine, eviction, and sanctions.
    4. Students shall leave their room, bathroom and/or suite in the clean and orderly condition in which they found it at the beginning of the year (this includes restoring any College-owned furniture that was put into storage). Failure to leave the room in its original condition shall result in fees for recovery and installation of missing items ($25 per item), replacement or repair of damaged or lost items (actual or use-prorated cost), and excessive cleaning costs (actual cost of special cleaning, painting, or repair).
    5. The student shall keep the premises free of toxic wastes, hazardous materials, pollutants, contaminants, and environmental damage. Should any of the aforesaid substances be brought onto the premises during tenancy, the student agrees to immediately remove the substances in accordance with existing environmental laws and leave the property free of any such substances.
    6. No waterbeds or liquid-filled furniture shall be kept or allowed in or about the building.
    7. The student shall indemnify the College for liability for personal injuries or property damage caused or permitted by the student, her/his guests, or invitees.
    8. Failure to sign and return this agreement to the Dean of Students Office will result in the student not being eligible to enter Room Draw 2009.
