1. County Issue: Building Codes and Zoning
In order to ensure public safety and address county concerns, FWC is considering a change to Rule 68A-6.003, Florida Administrative Code (F.A.C.). The change would require facilities housing Class I or Class II wildlife to meet local building codes for the construction of such facilities and zoning codes to ensure that facilities are compatible with proposed activity and location.

Counties are notified of any new application for Class I or Class II wildlife. The proposed change would require counties to address discrepancies to FWC within 30 days of notification. If they do not, the facility is deemed in compliance. Two options are provided for consideration.

Option A would require facilities housing Class I or Class II wildlife to meet local building codes for the construction of their facility. It would also require facilities housing Class I wildlife to meet valid local zoning requirements to ensure the facility is compatible with the area.

Option B would require facilities housing Class I or Class II wildlife to be in compliance with both local building codes and zoning codes.

2. Critical Incident and Disaster Plan
Class I, II, and III captive wildlife facilities must have a Critical Incident and Disaster Plan (CIDP). This is a two part form that provides emergency contact information (Part A) and states a plan of action to be taken in the event of a critical incident or natural disaster (Part B). FWC is considering a change to Rule 68A-6.0022, F.A.C., which would require captive wildlife facilities to share their plan (Part B) with their County Emergency Manager. Two options are provided for consideration.

Option A would require facilities housing Class I wildlife to share Part B of their CIDP with their County Emergency Manager.

Option B would require facilities housing Class I or Class II wildlife to share Part B of their CIDP with their County Emergency Manager.

3. Labeling of shipments containing live specimens of wild animal life.
The FWC is considering expanding transportation requirements to require anyone shipping or delivering live wild animal life in inter or intrastate commerce to label such packages. The label would list the name and address of the sender and receiver, and identify the number and species of live wild animal life in the shipment.

4. Exhibit/Sale License Requirement for Hobbyists
Currently a license is required to possess captive wildlife for exhibition or public sell. Individuals that exhibit and/or sell wildlife must demonstrate sustained and consistent commercial activity.

A hobbyist is one who possesses captive wildlife for their own personal use and enjoyment. Hobbyists may occasionally exhibit and/or sell their wildlife, but such commercial activity is rare and not the primary reason they have the wildlife. These individuals are generally not able to demonstrate sustained and consistent commercial activity during a licensing period; however, a license is still required for a hobbyist to sell or exhibit wildlife.

FWC is considering a rule change that would exempt hobbyists that occasionally exhibit or sell Class III wildlife from demonstrating sustained and consistent commercial activity during a licensing period.
